Overview

By accessing the Flexion SDK, documentation, associated libraries, binaries, and Connected Test Mode application (collectively referred to as the Software), you agree to these Terms of Use.

The Software is provided solely for the purpose of evaluating and integrating Flexion technology into your application for distribution through Flexion's supported alternative app store network.

⚠ImportantThe Software is proprietary to Flexion and is provided under the terms of an existing commercial agreement, NDA, or the confidentiality provisions described below.

At a Glance

By using the Software, you agree that:

• The Software remains the intellectual property of Flexion.
• The Software may only be used for evaluating or integrating Flexion services.
• The Software may not be shared with third parties.
• Reverse engineering, modification, or redistribution is prohibited.
• Personal access tokens must not be shared.
• Confidential information must be protected.
• Flexion may update these Terms of Use at any time.

Permitted Use

The Software is provided solely for the purpose of:

• Evaluating the Flexion platform
• Integrating Flexion technology into your application
• Testing Flexion functionality
• Preparing your application for distribution through Flexion

No other use is permitted without prior written approval from Flexion.

Restrictions

Unless explicitly authorized by Flexion in writing, you may not:

• Reproduce the Software
• Modify the Software
• Create derivative works
• Reverse engineer the Software
• Decompile or disassemble the Software
• Redistribute the Software
• Sublicense the Software
• Lease, rent, loan or transfer the Software
• Share the Software with third parties

You must not remove or alter any copyright notices, trademarks, proprietary notices or intellectual property markings contained within the Software or accompanying documentation.

Personal Access Tokens

Any personal access tokens provided by Flexion are intended only for the individual developer to whom they were issued. Developers must:

• Keep tokens secure
• Not share tokens with colleagues
• Not share tokens outside their organisation
• Report any suspected misuse immediately

Intellectual Property

The Software and associated interfaces are protected by intellectual property laws, including patents owned by Flexion. Current patent coverage includes:

• US Patent 10,127,035
• US Patent 11,099,833
• US Patent 11,875,146

Additional patents may be pending.

Confidentiality

Unless otherwise covered by an executed commercial agreement or NDA, all Software and associated materials provided by Flexion are considered confidential information. Confidential information includes, but is not limited to:

• SDKs and libraries
• Documentation
• Source materials
• Technical specifications
• Product roadmaps
• Pricing information
• Business strategies
• Customer information
• Security procedures
• Research and development materials
• Patents and intellectual property

Developers must:

• Keep all confidential information secure
• Use confidential information only for the permitted purpose
• Restrict access to employees who require access
• Ensure employees understand and comply with these obligations
• Obtain written approval before disclosing information to third parties

No Warranty

The Software and any associated confidential information are provided "as is". Flexion makes no representations or warranties regarding accuracy, completeness, reliability or suitability for a particular purpose. Developers assume all responsibility for their use of the Software.

Remedies

Developers acknowledge that unauthorized disclosure or misuse of the Software or confidential information may cause significant harm to Flexion. Flexion reserves the right to seek injunctive relief, equitable remedies, monetary damages, or any other remedies available under applicable law.

Changes to These Terms

Flexion may update these Terms of Use from time to time. Continued use of the Software following any updates constitutes acceptance of the revised terms.
